A homeless man pulls down his pants and throws himself at a woman - judge says it's not sexual assault

Rebekah Pedersen, a single woman, was nearly assaulted in broad daylight by a homeless man, Miguel Avila, outside the Village Market restaurant in Long Beach on October 20. Surveillance video shows Avila quickly approaching Pedersen, grabbing her and throwing her to the ground. A witness quickly neutralized him with pepper spray. Although Avila was arrested for sexual assault, the Los Angeles District Attorney's Office declined to charge him with attempted rape, as he had not expressed an intent to rape. Pedersen, distraught, is considering obtaining a firearms license and a Taser. Witnesses described the situation in Long Beach as worrying and advised women to take precautionary measures.
